EC publishes MiFID II and MAD consultation papers

Ana Herrero-WallaceIn December the EC published two significant consultation papers on the Review of MiFID and the Market Abuse Directive: Reinforcing sanctioning regimes in the financial services sector. In these documents the EC has posed over a hundred questions and invited comments on numerous topics in order to obtain industry feedback. This feedback will provide guidance for the Commission in preparing its formal proposals, scheduled for 2Q of 2011.

The deadline for feedback on the Review of MiFID is 2nd February 2011 and, for feedback on the Market Abuse Directive, 19th February 2011.

    Article in the press today suggests that the window of opportunity for for European rulemakers to assess industry concerns about the new regulation is too short. Apparently reforms over ‘dark pools’ and high frequency trading for equities have raised eyebrows. Liquidnet in particular have raised concerns.

    There was an interview yesterday in the press with Kay Swinburne MEP asking her how many responses have been received?

    She responded: “I don’t know. The server went down on the 2nd February, it collapsed under the weight of consultations coming in! All I know is that I was speaking at various events on the fringes of an AFME (Association of Financial Markets in Europe) conference last week and certainly every firm that was represented at the meetings I attended had all submitted a response, whether they were buy-side or sell-side. If that’s an indication, it should mean there’s been an extensive overall response”.

    I have heard that more than 1000 responses have been submitted. The EC certainly has its work cut out to review all the responses between now and their stated schedule of mid May!
